This Creative & Web Design Services Agreement ("Agreement") is entered into as of [Effective Date] between [Freelancer Name] ("Freelancer") and [Client Name] ("Client").
Freelancer will design and deliver the following (the "Deliverables"): [Description — e.g. logo files, website design mockups, a fully built website]. The Deliverables and file formats are described in more detail in [Attachment / Section reference].
This Agreement includes up to [Number] rounds of revisions per Deliverable. Additional revisions beyond this will be billed at [Rate] per hour, or as agreed in writing.
Client agrees to pay [Rate / Flat Fee], with [Deposit Amount or %] due upon signing and the remainder due upon completion. If Client cancels the project after work has begun, Client agrees to pay for all work completed up to that point, plus a kill fee of [Amount or %] if applicable.
Freelancer grants Client a license to use the Deliverables for the agreed purpose until full payment is received. Upon full payment, ownership of the final Deliverables transfers to Client. Freelancer retains ownership of preliminary drafts, unused concepts, and any pre-existing tools or assets used to create the Deliverables.
Unless Client requests otherwise in writing, Freelancer may display the completed work in their portfolio and reference the project for self-promotional purposes.
Work will begin on [Start Date] and is expected to be completed by [End Date], subject to timely feedback and materials from Client.
Freelancer is an independent contractor, not an employee of Client, and is responsible for their own taxes, insurance, and benefits.
