Frequently asked questions

This Promissory Note template is free to download — no account, no sign-up, and you can use it for as many loans as you need to document.

The interest rate (Section 2) is the part that needs a real check — most states cap the interest rate a private loan can charge (usury limits), and a rate set above that cap can make the interest unenforceable or, in some states, void the whole note. Whether the note is secured or unsecured (Section 6) also changes what the lender can actually do if the borrower defaults, so that section shouldn't be left as a placeholder either way.

The principal amount, interest rate and how it accrues, a repayment schedule (installments or a lump sum, and by when), whether early repayment is allowed without penalty, what happens on default (including any late fee and when the full balance becomes due), and whether the loan is secured by collateral or unsecured. A governing-law clause matters here specifically because it determines which state's usury limits apply.
