Photography contracts run into issues that rarely come up in other freelance work — mainly around who can use the images afterward, and what happens when weather, a no-show, or a bad take derails a shoot. A generic freelance agreement usually misses all of it.

What's specific to photography work

Image usage rights, spelled out precisely. This is the single most disputed clause in photography work. Can the client use the images only for the stated purpose (e.g. a specific ad campaign), or for anything? Personal use and commercial use are usually licensed differently — a couple using wedding photos on social media is a different license than a company using product photos in national advertising. State the scope, duration, and whether it's exclusive.

Copyright retention. In most cases, the photographer retains copyright even after delivering the images and licensing their use — the client is licensing usage rights, not buying the copyright itself, unless the contract explicitly says otherwise ("work made for hire" or an explicit copyright assignment). Be clear about which one applies, since it affects who can license the images to anyone else later.

Model and property releases. If people are identifiable in the images, or you're shooting on private property, releases need to be signed by the subjects (or a parent/guardian for minors) before the images can be used commercially — not just by the client who hired you. Specify who's responsible for collecting these.

Deposits and retainers. A non-refundable deposit to hold the date is standard in photography — it compensates you for turning away other bookings, not just for the eventual shoot. State the deposit amount, when it's due, and your cancellation/refund policy clearly.

Weather and rescheduling terms. For outdoor shoots, define what counts as weather bad enough to reschedule, who makes that call, and whether rescheduling costs anything.

Delivery timeline and format. State how many images are delivered, in what format (RAW vs. edited JPEGs), how long editing takes, and whether watermarked proofs are provided before final delivery.

A practical structure

  1. Shoot details: date, location, duration, deliverable count.
  2. Deposit amount, due date, and refund policy.
  3. Usage rights: personal/commercial, exclusive/non-exclusive, duration.
  4. Copyright retention statement.
  5. Model/property release responsibility.
  6. Weather/rescheduling terms (for outdoor shoots).
  7. Delivery timeline and file format.
