Frequently asked questions

Nothing — download it with no account and no sign-up, and use it for as many separations as you need to process.

The release of claims (Section 3) is the core of the document — the employee gives up their right to sue in exchange for severance, so it needs to be clear about what's being released and what isn't (rights that can't legally be waived, or claims that arise after signing, stay open). Section 8's review period is where you should add any legally required consideration or revocation window for the employee's age and jurisdiction — for employees 40 or older, U.S. federal law requires specific timeframes here, so that's worth getting right rather than leaving generic.

Severance amount and payment timing, a release of claims, return of company property, confidentiality of the agreement's terms, a non-disparagement clause, how reference checks will be handled, and a review period before signing. If the employee is 40 or older, don't skip the legally required review/revocation period language — a release signed without it can be unenforceable.
