Freelance Photography Services Agreement

1. Parties & Effective Date

This Freelance Photography Services Agreement ("Agreement") is entered into as of [Effective Date] between [Photographer Name] ("Photographer") and [Client Name] ("Client").

2. Shoot Details

Photographer will provide photography services for [Description of Event / Project] on [Date(s)] at [Location(s)], for approximately [Number] hours. Any time beyond the agreed duration is billed at [Overtime Rate].

3. Payment & Retainer

Client agrees to pay a total fee of [Amount], including a non-refundable retainer of [Retainer Amount] due upon signing to reserve the date, with the balance due [Timing — e.g. on or before the shoot date].

4. Image Delivery

Photographer will deliver [Number] edited images within [Number] days of the shoot, via [Delivery Method — e.g. online gallery]. Raw/unedited files are not included unless separately agreed in writing.

5. Usage Rights & Licensing

Upon full payment, Client receives a [license scope — e.g. personal, non-commercial] license to use the delivered images. Any commercial use, resale, or use in paid advertising requires a separate written license from Photographer. Photographer retains copyright in all images and may use them for portfolio, marketing, and promotional purposes unless Client opts out in writing.

6. Model & Property Releases

Client is responsible for obtaining any necessary model releases from individuals appearing in the images and property releases for private locations used, unless Photographer separately agrees in writing to obtain them.

7. Cancellation & Rescheduling

If Client cancels more than [Number] days before the shoot, the retainer is forfeited but no further fees are owed. Cancellations within [Number] days of the shoot forfeit [Percentage]% of the total fee. Rescheduling is subject to Photographer’s availability and may incur a [Rescheduling Fee].

8. Liability

Photographer’s liability for any claim arising from this Agreement is limited to the total fees paid. Photographer is not responsible for circumstances beyond reasonable control (illness, equipment failure, extreme weather) preventing the shoot; in such cases Photographer will offer to reschedule or refund amounts paid for services not rendered.

9. Termination

Either party may terminate this Agreement with written notice before the shoot date, subject to the cancellation terms above.

10. Governing Law & Signatures

This Agreement is governed by the laws of the State of [State / Jurisdiction].
